Gallery Sille Terms and Conditions for renting and purchasing art.

The works of art will only be lent or sold by Gallery Sille after the customer has taken note of the Terms and Conditions.
 
Delivery with rent of purchase
The Customer may choose to collect the work of art at the gallery in Oudewater, or for delivery. Delivery in the Netherlands will take place at a rate of 0.44 cents per km. With purchases over € 1500, no delivery costs are charged within the Netherlands. This excludes the islands, works weighing more than 40 kg or works which dimensions exceed 2 meters. Gallery Sille charges € 50 delivery fees outside of the Netherlands. We have special arrangements for rental outside Netherlands, please contact us.
 
 
Payment method for rent or purchase
After an order confirmation, Gallery Sille will discuss the payment method with the customer. Advance payment, by invoice or cash on delivery. Rent amounts up to € 25 per month should be paid every 6 months. Rent amounts between € 25 and € 45 per month should be paid quarterly. Rent amounts above € 45 per month should be paid monthly. Gallery Sille is entitled to collect the works of art if payment is not made. However, the payment obligation remains in force, and the additional transportation costs are also charged. If the Client still does not pay, or not fully, or not before the deadline for payment laid down in the reminder, after sending the reminder, Gallery Sille has the right to charge its extrajudicial (collection) costs to the Client's account.
 
Money back guarantee with rent or purchase
Gallery Sille applies a money back guarantee with direct purchase and rental amounts above € 45 per month. The Client must notify Gallery Sille by phone, within 2 days after delivery, if they decide not to buy the work of art. The amount paid, less a contribution of € 25 for the administrative costs incurred, will be refunded to the Client's account. The Client will receive a voucher for the amount of € 25, which can be used to rent or purchase any other work of art.
 
Rental period 
The rental period is a maximum of 6 months, beginning on the date of delivery or installation. Gallery Sille will contact the Client prior to the expiry of the rental period. The Client will have the first option to purchase the work of art, in which case the Client will be reimbursed the rental cost plus the accrued savings, which will be deducted from the purchase price. If the work of art is not purchased by the Client after the rental period, Gallery Sille will make an appointment to return the work of art. If the Client cannot return the work of art at the end of the rental period (for example due to holidays), he should notify his contact at Gallery Sille at least two weeks prior the beginning of the period in which he will not be available. If the Client does not return the work of art in time, Gallery Sille may regard the work of art having been purchased, and Gallery Sille is entitled to claim the full value of the work of art, as indicated on the order confirmation / invoice.
Accumulated savings with rent 
The savings accrued by the Client during the rental period can be used to purchase a work of art or an art voucher from Gallery Sille. Should the Client no longer want to rent an item from Gallery Sille, the accumulated savings remains at the Client's disposal for 12 months, unless otherwise agreed. The accrued savings may never be refunded or be settled with payment arrears incurred by the Client, compensation or interest and costs.
 
Liability in case of rent
Upon receipt, the Client must carefully inspect the work for errors and defects, and these should be reported to Gallery Sille within 24 hours, failing which the Client acknowledges that the work of art was received in a good condition. Gallery Sille or the artist shall at all times remain the owner, it is forbidden to reproduce the works of art (or have them reproduced), exhibit them elsewhere, or to rent or loan the works of art to third parties. The works of art should never be moved by the Client himself, and the Gallery should be notified in writing, in a timely manner, in the event of a change of address. The Client should treat the works of art with care, and the works of art may not be placed in the immediate vicinity of heat sources, direct sunlight or a damp place. The Client is required to notify Gallery Sille immediate, in writing, in case of damage, theft or loss of the work of art. It is not allowed to carry out repairs personally, or to commission repairs. The Client is liable for all damage to the artworks, caused by negligence. For complaints about a work of art not in possession of Gallery Sille, Gallery Sille will refer the Client to the relevant art provider, and provide the Client with the particulars of the relevant art provider.
